Terms of Service

1. Purpose and Effectiveness of These Terms

These Terms of Service ("Terms") govern the rights, obligations, and responsibilities, as well as other necessary matters, between Lifebuddy ("the Company") and users, in connection with the use of the Texty app ("Service") provided by the Company. By agreeing to these Terms, users can use the Service. These Terms become effective by being posted through the Service interface, application, website, or other methods.

2. Definitions

The key terms used in these Terms are defined as follows:

1. "Service" refers to all features provided by the Company, including adding text, images, and emoticons to photos selected by the user, and related functionalities.
2. "User" means any individual who agrees to these Terms and uses the Service.
3. "Content" refers to any results created or edited by the User using the Service, including photos, text, images, emoticons, etc.

3. Posting and Revision of Terms

The Company posts these Terms on the app or website where the Service is provided so that Users can check them at any time. If necessary, the Company may revise these Terms within the scope permitted by applicable laws. Any revised Terms will be announced through the app or website before their effective date, and become effective on that date. If a User continues to use the Service after the revised Terms come into effect, the User is deemed to have agreed to the revised Terms.

If a User does not agree to the revised Terms, they may stop using the Service.

4. Service Use

Users can use the Service without a separate registration process by agreeing to these Terms.

5. Description and Use of the Service

1. Photo Editing Function: Users can load photos stored on their device or take new ones through the Texty app and edit them by adding text, stickers, drawings, etc. The edited results are saved on the User's device.
2. Advertising Display: The Service may include third-party advertisements, such as Google AdMob. The content of advertisements is displayed according to the policies of the advertising providers. The Company does not guarantee the accuracy or reliability of the ad content and is not responsible for any issues that may arise from the advertisements.

The Company makes continuous efforts to provide a stable Service but may temporarily suspend the Service in unavoidable circumstances such as natural disasters or technical issues. In such cases, the Company will provide prior notice or inform Users promptly afterwards.

6. Protection of Personal Information

The Company values the User's personal information and handles it in accordance with relevant laws and the "Privacy Policy." Please review the Privacy Policy before using the Service.

7. User Obligations

Users must not engage in the following:

1. Using the Service for illegal or inappropriate purposes
2. Altering, deleting, copying, or distributing Service content without permission
3. Unauthorized use of other users' photos or content, or infringing on the rights of third parties, such as copyright or portrait rights
4. Interfering with the normal operation of the Service (e.g., hacking, server attacks)
5. Any acts that violate applicable laws or these Terms

If a User's actions cause damage to the Company or a third party, the User shall bear all civil and criminal liability.

8. Restrictions on Service Use and Termination

1. Restrictions on Use: If a User violates these Terms or any applicable law, or if they use the Service in an improper manner, the Company may temporarily or permanently restrict the User's access without prior notice.
2. Termination by User: A User may stop using the Service at any time by deleting the app.
3. Termination by the Company: The Company may suspend the provision of the Service for reasonable reasons, such as business judgment or technical issues, and will provide prior notice in such cases.

9. Disclaimer

The Company is not liable if it is unable to provide the Service due to force majeure events including natural disasters, war, terrorism, hacking, server failures, communication outages, or the intentional or negligent acts of third parties.

The Company is not responsible for any failure to obtain expected profits or losses incurred by the User through the use of the Service, nor for damages incurred by the User in connection with the use of the Service that are due to the User's intentional actions or negligence.

The User is solely responsible for the content, quality, legality, and any legal issues (including copyright and portrait rights infringement) arising from the content created and edited by the User.

10. Limitation of Liability

The Company does not make any warranties beyond what is explicitly stated in these Terms. To the extent permitted by law, the Company is not liable for any indirect, incidental, special, or punitive damages arising out of or in connection with the User's use of the Service.

11. Governing Law and Jurisdiction

These Terms and the Service are governed by and construed in accordance with the laws of the Republic of Korea. Any disputes arising from the use of the Service shall be subject to the exclusive jurisdiction of the court with jurisdiction over the Company's registered address, unless otherwise stipulated by applicable laws.

12. Supplementary Provisions

These Terms take effect on April 12, 2025. The Company may establish additional terms or separate agreements if necessary, and in the event of any conflict between such additional terms or agreements and these Terms, the separate agreement takes precedence.
